What is a DPO?
A Data Protection Officer (or DPO) is a new profession brought about by the General Data Protection Regulation (GDPR). It is a person within a company or an administration responsible for the protection of personal data.
The challenges of the DPO
The Data Protection Officer is responsible for training data controllers within the organisation to ensure compliance with the requirements of the GDPR. The DPO may either be an employee under the direction of the data controller within the organisation or act as a subcontractor. It is also possible for the DPO to be hired through a service contract.
Who is affected by the establishment of a DPO?
The persons concerned by the designation obligation a DPO are set out in Article 37 of the GDPR.
In the public sector, this will involve a DPO in all public structures processing personal data such as the State, local authorities, etc.
In the private sector, the aim will be to engage a DPO in companies with a certain type of activity:
- or those carrying out processing operations that require regular and systematic monitoring of data subjects on a large scale.
- or those consisting of large-scale processing of special categories of data referred to in Article 9 of the GDPR (which includes "sensitive" data: racial or ethnic origins, political or religious beliefs, etc.) and personal data related to criminal convictions and offences under the Article 10 of the RGPD.
