What is a joint and several guarantee deed?<\/h2>

The deed of guarantee<\/strong> is a document by which a party called deposit<\/strong>\u00a0guarantees a debtor<\/strong>. Generally, it is a contract annexed to a main contract in which the debtor undertakes to pay a sum to the creditor.<\/p>

This contract thus ensures that the creditor will get the sums due.<\/p>

The issues of the bond deed<\/h2>

The joint surety<\/strong> implies a strong power for the creditor since he will be able to pursue both the principal debtor<\/strong> than the guarantor for the payment of the sums due to him. The guarantor's undertaking must therefore be conscious and express<\/strong> within the instrument, in particular by a handwritten note.\u00a0<\/p>

In addition, if the deed of guarantee binds the Guarantor, it may also bind his spouse<\/strong> in the event that the latter gives his consent. The interest here is to allow the joint property of the spouses to be involved in the guarantee.\u00a0<\/p>
